Who Is Looking for Your “Abandoned” DNA?

Samdperil & Welsh, PLLC

information it contains.  “Abandoned DNA” comes into play when the police don’t have a DNA sample, and can’t force a suspect to give one up.  So they search through trash for coffee cups, cigarette butts, anything that might contain a suspects genetic material.  What they find, could belong to the suspect … or you.

Privacy experts and the courts disagree about the privacy rights we have over our DNA in the context of a police investigation.  See the Boston Globe article.

Later this spring the Supreme Court will decide, in the case Maryland v. King, whether the police can force a suspect to give a DNA sample when he or she has merely been arrested—but not yet convicted—for a crime.

What People Say About Us

Richard Samdperil provided an exemplary level of professionalism and efficiency along with a compassionate understanding of my situation. I’d spoken to numerous attorneys before requesting assistance from Richard and am honestly so happy that I did.

Victoria M.

Joe did a great job. Very knowledgeable, upfront and honest. I’m not a New Hampshire resident but if for some reason I needed representation again, I wouldn't hesitate to call him again.

Matt

Attorney Welsh helped me through a very difficult legal matter. I felt very lost at the time and truly had never needed legal representation before in my life. I am very grateful I chose to work with this law firm as they are highly professional and understanding.
