NH DWI - 4th or subsequent Offense
Class B Felony
Jail Sentence
Minimum: 6 months, of which 5 months may be suspended (i.e, at least 30 days in jail)
Fine
Minimum: $750.00, plus 24% penalty assessment
Court-ordered Loss of License
Indefinite, with the right to petition for reinstatement after 7 years in most cases.
Required Treatment
28 day residential treatment program (or another intensive treatment program approved by NH Dept. of Health and Human Services)
The court may impose additional treatment and/or counseling conditions as well, including random urine tests.
Administrative License Suspension (ALS) by the NH DMV
Ignition Interlock Requirement
Minimum: 1 year
Maximum: 2 years
Insurance requirements
Proof of an SR-22 prior to reinstatement.
Other Penalties
6 demerit points
