DWI - 2nd offense

(prior conviction within the past 10 years)

Class A Misdemeanor

Jail Sentence

- where the prior conviction was within the past 2 years.

Minimum: 30 days*

 

Maximum: 1 year*

 

*followed by 7 days at the Multiple Offender Program (MOP)

 

 

Jail Sentence

- where the prior conviction was more than 2 years before the current charge.

Minimum: 3 days*

 

Maximum: 1 year*

 

*followed by 7 days at the Multiple Offender Program (MOP)

Fine

Minimum: $750.00, plus 24% penalty assessment

 

Maximum: $2000.00, plus 24% penalty assessment

 

Most district courts require fines to be paid in full on the date of trial or sentencing.

 

Court-ordered loss of license

3 years

 

 

Administrative License Suspension (ALS) by the NH DMV

Minimum: 2 years in most cases, potentially longer.

Required Treatment

7 day Multiple Offender Program (MOP), which must immediately follow any jail sentence.  Cost is approx. $1550.00.

 

Failure to complete the program is considered contempt of court and will result in a 14 day jail sentence.

 

The court may impose additional treatment and/or counseling conditions as well, including random urine tests.

Ignition Interlock Requirement

Minimum: 1 years

 

Maximum: 2 years

Insurance requirements

Proof of an SR-22 prior to reinstatement.

6 demerit points

 

Major motor vehicle conviction which counts toward certification as an habitual offender.
